These Terms of Sale apply to subscriptions to wallabag.it, a hosted read-it-later service published by Nicolas Lœuillet, sole proprietor.

Article 1: Purpose

wallabag.it is a digital service that lets users save web pages, read them later, organize them and export them from a user account.

These Terms of Sale define the rights and obligations applicable to the subscription to wallabag.it.

Article 3: Acceptance of the Terms

The Customer declares that they have read these Terms of Sale before confirming their order and accepts them without restriction or reservation.

The applicable Terms are those in force on the date of the order. wallabag.it may amend these Terms at any time for the future by publishing a new version on the website.

Article 4: Service description

wallabag.it provides access to a hosted instance of the free and open-source wallabag software, with the features presented on the website: article saving, read-it-later, organization, search, import, export and synchronization with compatible applications.

The service is provided online. The Customer is responsible for their Internet access, equipment and software or application compatibility.

Article 5: Free trial

wallabag.it may offer a free trial period, without requiring a payment card, whose duration and possible limitations are indicated on the website.

At the end of the free trial, no automatic payment is made. To continue using the service, the Customer must choose and pay for a subscription.

Article 6: Subscriptions, duration and renewal

Available subscriptions, their duration and their prices are indicated on the pricing page of the website.

Unless otherwise stated at the time of order, wallabag.it subscriptions do not renew automatically. The Customer must renew the subscription at the end of the chosen period if they wish to continue using the service.

Article 7: Prices

Prices are shown in euros on the website at the time of order.

wallabag.it reserves the right to change its prices at any time for the future. Price changes do not apply to subscriptions already paid for their current period.

Telecommunication costs required to access the website and service remain the responsibility of the Customer.

Article 8: Order

To subscribe, the Customer selects the desired plan, checks the order information, accepts these Terms and proceeds with payment.

The Customer undertakes to provide accurate and up-to-date information. wallabag.it may refuse or cancel an order in the event of an abnormal, fraudulent or bad-faith request, or for any legitimate reason.

Article 9: Payment

Payment is due at the time of order.

Online payment is processed by the payment providers offered at the time of order, including Stripe, Payplug or PayPal.

wallabag.it does not see or store full payment card details. Transactions are processed directly by payment providers.

In the event of payment failure or cancellation, the subscription is not activated or may be suspended.

Article 10: Access to the service

The subscription grants access to the service for the chosen duration, subject to compliance with these Terms.

wallabag.it uses reasonable efforts to ensure service availability. The service may nevertheless be temporarily interrupted for maintenance, update, technical incident, security or force majeure.

Article 11: Use of the service

The Customer undertakes to use wallabag.it in accordance with the law, these Terms and the normal purpose of the service.

In particular, it is prohibited to use the service to:

  • attempt to compromise the security or operation of the service;
  • automate abusive or disproportionate usage;
  • store or distribute manifestly unlawful content;
  • infringe third-party rights.

In the event of abusive, fraudulent or unlawful use, wallabag.it may suspend or close the relevant account, after informing the Customer where possible, without prejudice to available legal action.

Article 12: Right of withdrawal

In accordance with consumer law, a consumer Customer has 14 days from subscription to exercise the right of withdrawal, without having to give any reason.

The right of withdrawal may be exercised by writing to nicolas@wallabag.it, indicating the email address of the relevant account and a clear wish to withdraw.

In the event of a valid withdrawal, wallabag.it refunds the amounts paid within 14 days of receiving the request.

If the Customer expressly requests immediate access to the service before the end of the withdrawal period, an amount proportional to the period actually used may be retained where permitted by law.

Article 13: Refunds and complaints

Any refund request or complaint may be sent to nicolas@wallabag.it.

The request must indicate the email address of the relevant account, the subscription concerned and the reason for the request.

Article 14: Personal data

Personal data processed for the order, subscription and use of the wallabag.it service is described in the Privacy notice.

Full payment card details are not stored by wallabag.it. They are processed directly by the payment providers used for the transaction.

Article 15: Export and account deletion

The Customer can export their data from the service in the formats provided by wallabag.it.

The Customer can request deletion of their account by writing to nicolas@wallabag.it. Deletion terms, including handling of technical backups, are described in the Privacy notice.

Article 16: Intellectual property

Trademarks, domain names, texts, images, graphic elements and, more generally, content published by wallabag.it remain the property of their respective owner.

The wallabag software is free and open-source software governed by its own license. These Terms do not transfer any intellectual property rights to the Customer, except for the personal right to use the service during the subscription period.

Article 17: Legal guarantee of conformity

Consumer Customers benefit from the legal guarantee of conformity applicable to digital services, under the conditions provided by the French Consumer Code.

In the event of a lack of conformity, the Customer may contact wallabag.it at nicolas@wallabag.it to request that the service be brought into conformity or any other remedy provided by law.

Article 18: Liability

wallabag.it is liable for the proper performance of its contractual obligations under the conditions provided by law.

wallabag.it cannot, however, be held liable for damage resulting from misuse of the service by the Customer, an unforeseeable and unavoidable act of a third party, force majeure, unavailability of the Internet network, or a third-party service used by the Customer.

Article 19: Force majeure

Performance of wallabag.it’s obligations may be suspended in the event of force majeure under French law. wallabag.it will inform the Customer of such an event as soon as possible where feasible.

Article 20: Consumer mediation

In accordance with the French Consumer Code, a consumer Customer may use a consumer mediator free of charge to seek amicable resolution of a dispute with wallabag.it, after first sending a written complaint to wallabag.it.

The contact details of the competent mediator will be provided on request or added to these Terms once the applicable mediation service has been designated.

Article 21: Applicable law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution. Failing that, the dispute will be brought before the competent courts under ordinary law.
